1. Introduction

Welcome to Will Nolan (the "Website"). By accessing and using the Website, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before using the Website.

2. Artwork Description

We strive to accurately represent the artwork for sale on the Website. However, variations in color and detail may occur due to the nature of photography and individual monitor settings. All artwork is sold as is. Framed artworks will be clearly indicated. Dimensions provided are approximate.

3. Ordering and Purchase

When you place an order through our store, you are offering to purchase the artwork at the displayed price, including shipping. We reserve the right to accept or reject any order at our discretion. Once your order is accepted, you will receive a confirmation email from us (Will Nolan). All prices are in Australian Dollars (AUD). Your contract for the purchase of the artwork is with Will Nolan.

4. Payment

Payment for orders placed through our Squarespace shop is processed by Squarespace. We accept the payment methods offered by Squarespace, which includes, Credit Card (Visa, Mastercard, American Express), PayPal and more. Payment must be received in full before the artwork is shipped. Please refer to Squarespace's terms and conditions for more information regarding payment processing.

5. Shipping

Domestic (Australia): We ship Australia-wide. Shipping costs are calculated at checkout and are based on the size, weight, and destination of the artwork. We aim to dispatch orders within 7 business days of receiving confirmation of your order from Squarespace. You will receive a tracking number once your order has been shipped. Delivery times may vary depending on your location and the shipping carrier. We use Australia Post, Pack and Send and a variety of Couriers for domestic deliveries.
International: We welcome international orders! Please contact us via will@willnolan.com.au to discuss shipping options, costs, and available destinations. We are happy to provide personalised quotes for international delivery. Please note that international customers are responsible for any customs duties, taxes, or import fees imposed by their country. Shipping times and available carriers will vary depending on the destination.
Collection (If Applicable): If you choose to collect your artwork in person, please arrange a suitable time with us. Unless otherwise agreed in writing, all collected artwork must be picked up within 14 days of purchase. Artworks not collected within this timeframe may incur a storage fee.

6. Returns and Refunds

We want you to be delighted with your artwork. While we take every care to accurately represent our art and ensure its safe delivery, we understand that issues can sometimes occur.

Damaged or Significantly Different: If your artwork arrives damaged in transit or is significantly different from the description and images displayed on our website (a failure to meet a Consumer Guarantee), please contact us within 7 days of delivery via will@willnolan.com.au.

Your email must include:

Your order number.
Clear photos of the damage or discrepancy.
A detailed description of the issue.

Assessment: We will assess each claim promptly. We may request additional information or photos. For damaged artwork, please retain the original packaging.

Remedies: We will, in accordance with Australian Consumer Law, offer an appropriate remedy which may include:

Replacement (if available): If a replacement is available, we will ship it to you at no additional cost.
Repair: If the artwork can be repaired, we may arrange for a professional repair.
Refund: If a replacement or repair is not feasible, we will issue a full or partial refund via Squarespace, depending on the extent of the damage or discrepancy.

Change of Mind: We do not offer refunds or returns for change of mind. Please choose your artwork carefully.

Return Shipping:

If the artwork was damaged in transit or there was an error on our part (i.e., a failure to meet a Consumer Guarantee), the return shipping costs will be our responsibility, and we will reimburse you for any reasonable postage costs incurred.
In all other cases, return shipping will be the responsibility of the customer. We will provide instructions for return shipping if a return is authorised.

International Returns: For international returns, please be aware that any customs duties, taxes, or import fees you paid are your responsibility, and we cannot refund them.

7. Copyright

All artwork and images on the Website are the copyright of Will Nolan and may not be reproduced without prior written permission. Purchase of artwork does not transfer copyright.

8. Unique Artworks and Limited Edition Prints

Unique Artworks: Our unique artworks are one-of-a-kind pieces. Only one of each unique artwork is available for sale. These works are also accompanied by a certificate of authenticity.
Limited Edition Prints: Limited edition prints are numbered and come with a certificate of authenticity. Once the edition is sold out, no further prints will be made.

9. Framing

Framed artworks are carefully packaged to prevent damage during shipping. Our framed works are available with two glazing options: glass or museum-grade acrylic (also known as Perspex). The specific glazing material used for each artwork will be clearly stated in the artwork's description. If you have a preference for one over the other for a particular piece, please contact us prior to purchase to discuss availability and any potential price adjustments. While we take every precaution to protect the framing and glazing, we are not responsible for minor imperfections that may occur during transit.

We make every effort to ensure the accuracy of the information on the Website. However, we are not liable for any errors or omissions.

These Terms are governed by the laws of South Australia, Australia.
